Fiji Airways $49 Deposit Promotion

Eligibility:

  • Bookings must be made solely through the website https://www.paylatertravel.com/ and not via any other online platform or company site, including Fiji Airways’ website.
  • Eligible flights must be operated exclusively by Fiji Airways network. Flights involving any other airline are deemed ineligible for this promotion, including multi-carrier flights, even if one flight in the journey is Fiji Airways, if the route includes others, it’s not eligible.
  • Departure destinations are restricted to anywhere from the U.S. and must be operated by the Fiji Airways network.

Promotion Period:

  • The promotion is valid for bookings made between 12:01am EST on 1st March 2025 and 11:59pm EST on 15th April 2025. Bookings made outside this period are not eligible for the offer. Limited time offer, subject to modification or withdrawal at any time without prior notice.

Booking and Travel Classes:

  • This promotion applies to all Economy Class fares only.
  • Premium Economy, Business Class, First Class, and Multi-Carrier fares are expressly excluded from this promotion.
  • Return only fares are included whilst one-way fares are excluded.

$49 Deposit

  • A deposit of $49 USD per eligible booking is required at the time of booking. The remaining balance must be paid in accordance with standard booking schedule and T&Cs.

Flight Prices and Additional Charges:

  • All purchase prices are listed in United States Dollars (USD) and inclusive of applicable taxes.
  • Prices are subject to alteration at any time without prior notice.
  • This promotion encompasses only the cost of the flight and applicable taxes. No additional services are included under this promotion.

Travel Dates:

  • Flights may be booked for departure at any time within the valid system range, subject to seat availability.

Combination with Other Offers:

  • This promotion cannot be combined with any other deals, promotions, or discount codes unless explicitly stated otherwise.

Refunds and Cancellations:

  • $49USD deposit is not eligible for a refund for any reason.
  • Refund and cancellation policies are detailed in the additional terms and conditions provided at the time of booking.
  • Customers must comply with the specified policies to be eligible for refunds or cancellations.

Changes to the Promotion

  • This offer is subject to modification or withdrawal at any time without prior notice.
  • PayLater Travel reserves the right to alter or cancel the promotion at its sole discretion.

Acceptance of Terms:

  • By participating in this promotion, customers agree to comply with all stated terms and conditions.

1. General

1.1. This website is operated by Sky Pay Group, Inc. under the brand name PayLater Travel. Throughout this site the terms “we”, “us” and “our” refer to PayLater Travel.

1.2. PayLater Travel provides access to information, tools and services from the PayLater Travel website, phone and email communication conditional upon your acceptance of the following terms, conditions, policies and notices (collectively referred to as the “Terms of Service,” “Terms,” or “Agreement”). Your access of our website or engagement with us through email or phone represents your agreement to be bound by these Terms and are inclusive of any amendments which PayLater Travel reserves the right to impose at any time.  Our website and the Services and the Product Listings and Travel Related Products made available through our website are collectively referred to as our “Platform.”

1.3. BY CLICKING “ACCEPT,” OR BY OTHERWISE ACCESSING OR USING OUR SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ IN ITS ENTIRETY, UNDERSTAND, AND FULLY ACCEPT ALL TERMS AND CONDITIONS CONTAINED IN THESE TERMS AND OUR PRIVACY NOTICE. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY NOTICE, YOU ARE NOT AUTHORIZED TO ACCESS OT USE OUR PLATFORM AND/OR THE SERVICES, PLEASE PROMPTLY EXIT THIS WEBSITE.

1.4. Unless the contrary intention appears, amendments to the Terms will take effect immediately from the date and time they are published on the website and will be incorporated into this Agreement. Terms apply to all users of our site and Services, including, without limitation, users who are browsers, vendors, customers, merchants and/or contributors of content.

1.5. By engaging with the tools and services on the PayLater Travel website you confirm that you are at least the age of eighteen (18). By making a purchase through the website you warrant that you are at least eighteen (18) years old and that you have the legal right and ability to enter into a legally binding agreement with us. No persons under the age of eighteen (18) are permitted to use the website or to sign up as a member of the website.

1.6. Binding Arbitration.  These Terms of Service provide that all disputes between you and PayLater Travel that in any way relate to these Terms of Service or your use of the Platform will be resolved by BINDING ARBITRATION. ACCORDINGLY, YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT (INCLUDING IN A CLASS ACTION PROCEEDING) to assert or defend your rights under these Terms of Service (except for matters that may be taken to small claims court). Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury and your claims cannot be brought as a class action. Please review the Section below entitled Dispute Resolution for the details regarding your agreement to arbitrate any disputes with PayLater Travel.

2. Terms of Website Usage

Website content
2.1. All pages, features and content within this Platform and any material made available for download are the property of PayLater Travel, or its licensors or suppliers, as applicable. The Platform is protected by United States and international copyright and trademark laws. The contents of the Platform, including without limitation all data, files, documents, text, photographs, images, audio, and video, and any materials accessed through or made available for use or download through this Platform (“Platform Content”) may not be copied, distributed, modified, reproduced, published or used, in whole or in part, except for purposes authorized by these Terms or otherwise approved in writing by PayLater Travel. You may not frame or utilize framing techniques to enclose, or deep link to, any name, trademarks, service marks, logo, Platform Content or other proprietary information (including images, text, page layout, or form) of PayLater Travel without our express written consent.

2.2 You must not reproduce, duplicate, copy, sell, resell or exploit any written material, visual material or code on the website, including these Terms, without express written permission from PayLater Travel.

Search Function, Product Listings & Quotes
2.3. The search function on our website retrieves general information about flight paths and pricings made publicly available from various airline ticketing providers. Our systems use this general information to detail a quote for the financial arrangement we are prepared to offer to our customers for their preferred flight options (referred to as “Product Listings”). Whilst we strive to ensure our system regularly updates, collects and publishes accurate and up to date information for each Product Listing, we cannot and do not warrant that all information published on PayLater Travel will be current, accurate, complete and/or free of system glitches.

2.4. Where we become aware of any error, omission or system glitch (“Error”), we reserve the right to correct that Error and notify affected customers immediately. Should you be a customer directly affected by an Error we will use our reasonable efforts to notify you within 5 days of your booking. We reserve the right to reject your transaction and provide a full refund due to any Error at our sole and absolute discretion.

2.5. All Product Listings are subject to revisions in line with any changes in price, time, dates, flight path or other associated ticketing details that each airline ticketing provider makes at any time.

2.6. Quotes are subject to change prior to your deposit being received.

Prohibited Uses
2.7. In addition to any other prohibitions as set forth in this Agreement, you are prohibited from using the site or its content:
  1. for any unlawful purpose;
  2. to solicit others to perform or participate in any unlawful acts;
  3. to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances or local laws;
  4. to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
  5. to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
  6. to submit false or misleading information;
  7. to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet;
  8. to collect or track the personal information of others;
  9. to spam, phish, pharm, pretext, spider, crawl, or scrape;
  10. for any obscene or immoral purpose; or
  11. to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.
2.8 PayLater Travel reserves the right to terminate your use of the Service or any related website for engaging in any of the prohibited uses. If your use of the Service is terminated after a purchase has been made, a refund will be issued in accordance with our cancellation and refund policies set forth under the Terms.

2.9. In line with our regulatory requirements for anti-money laundering and sanctions screening, we cannot register clients, provide our service for travel to or from these countries, receive funds from or send money to the following jurisdictions: Cuba, Iran, Syria, North Korea, Crimea.

Third Party Links
2.10. Certain content, products and services available via our Service may include materials from third parties.

2.11. Third-party links on this site may direct you to third-party websites that are not affiliated with PayLater Travel. PayLater Travel is not responsible for examining or evaluating the content or accuracy of any third-party materials.

2.12. PayLater Travel does not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third parties.

2.13. PayLater Travel is not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third- party links. Please review third-party links carefully and make sure you understand them before you engage in any transaction.

2.14. Complaints, claims, concerns, or questions regarding third-party linked products should be directed to the third party.

Comments, Feedback and other Submissions
2.15. If, at the request of PayLater Travel, you send certain specific submissions (for example contest entries) or without a request from PayLater Travel you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, “Comments”), you agree that PayLater Travel may, at any time and without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any Comments that you forward to us. We are and shall be under no obligation to maintain any Comments in confidence, pay compensation for any Comments, or respond to any Comments.

2.16. PayLater Travel may, but has no obligation to, monitor, edit or remove content that we determine, in our sole discretion, as being unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

2.17. You agree that your Comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your Comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website.

2.18. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead PayLater Travel or third-parties as to the origin of any Comments. You are solely responsible for any Comments you make and their accuracy. PayLater Travel takes no responsibility and assumes no liability for any Comments posted by you or any third-party.

3. Services

3.1. PayLater Travel provides a travel concierge service through which PayLater Travel will reserve and hold Travel Related Products on users’ behalf and then transfer those Travel Related Products to users once they have paid PayLater Travel (typically in two or more installments) in accordance with the these Terms (the “Service”). The Service is more fully described in this Section 3.

3.2. For purposes of this Agreement, “Travel Related Products” means airline tickets, hotel accommodation, tours and other similar travel related products provided by third party travel companies (“Travel Providers”).

Booking Terms and Conditions
3.3. By using our Services to procure a Travel Related Product, you provide us with unconditional and irrevocable consent and direction to pay the Travel Provider on your behalf in exchange for your agreement to pay to us in accordance with this Agreement, the agreed amounts (which may include any applicable taxes, duties or other related amounts charged by an Travel Provider) and on the dates outlined in your Payment Schedule (defined below), plus any additional applicable fees.

3.4. All prices quoted are in United States dollars (“$” or “USD”) unless otherwise specifically denoted on the screen.

3.5 PayLater Travel makes no representation that airline price sales are identical to prices on individual airline sites that may exist from time to time.

3.6 Any changes and amendments of Travel Related Products on the customer’s behalf will incur a change fee of $75 per passenger, plus the airline change fee and any differences in fare between the two flight conditions. This applies to all passengers who occupy a seat; infants who sit on their parent or guardian’s lap for the duration of the flight may be exempt, subject to airline terms and conditions.

3.7 PayLater Travel reserves the right to modify prices if the price of a Travel Related Product is increased or if the price quoted is in error. In the case where the price of an applicable booking has increased by 5% or more due to reasons outside our control, we reserve the right to amend the remaining payment installments by written notice to you. You may choose to cancel your booking thereby discontinuing your payments in which case you’ll not be charged a cancellation fee and will be refunded any amounts paid.

Payment Schedule; Late Payments
3.8. We will provide you with a payment schedule (the “Payment Schedule”) at the time of quotation which will be customizable by you as more fully set forth in the Pricing Page.

3.9. PayLater Travel will use its commercially reasonable efforts to contact you should payments be missed, including via SMS, email or phone.

3.10. We will not charge you a late fee for missed payments, however, your financial institution may charge you a dishonor fee in the event of failed payments.

3.11. PayLater Travel does not issue credit, nor perform any credit checks.

3.12. Should you request, PayLater Travel will provide you with receipts of all payments.

Obtaining your Travel Related Product
3.13. We will be the registered recipient, traveler, guest, or beneficiary of all Travel Related Products unless and until you pay off the balance owing to PayLater Travel.  WE ARE UNDER NO OBLIGATION TO TRANSFER ANY TRAVEL RELATED PRODUCT TO YOU UNLESS AND UNTIL YOU HAVE PAID YOUR BALANCE IN FULL.

3.14. Upon the full and final balance being paid with the time period set forth in the Payment Schedule, we will provide you with your e-ticket (or other electronic booking information) for your applicable Travel Related Products. It will be sent to the email address provided to us at the time of booking.  You agree to cooperate with us in taking all necessary steps and providing all necessary information to transfer the Travel Related Products to your name.

3.15. Upon receiving your e-ticket you will be at liberty to access your flight information, hotel reservation, or other Travel Related Product using your preferred Travel Provider platform.

Payment Options; Customer Obligations
3.16. You must pay a non-refundable deposit in the amount set forth in the Pricing Page for all Services you purchase.

3.17. You will provide us with a valid debit or credit card for payment (the “Nominated Payment Option”).

3.18. By purchasing Services from PayLater Travel, you authorize PayLater Travel to debit the installments from your Nominated Payment Option, at the amounts and dates set in the Payment Schedule.

3.19. Should any changes to your Nominated Payment Option occur, you agree to promptly update your payment information, including card numbers and expiration dates, so that PayLater Travel can complete your transactions. If payment details need to be changed, please contact our Customer Service Team at support@paylatertravel.com or otherwise complete this on our Website.

3.20. You may request changes to your Payment Schedule, however, we do not guarantee that we will accommodate any requested changes once you have accepted your Payment Schedule at the time of purchase.  If you wish to alter your Payment Schedule, please contact: support@paylatertravel.com.  In any event, we require that any changes be made at least 48 hours prior to your next scheduled payment.

3.21. You are responsible for ensuring there are sufficient funds available through your Nominated Payment Option. Where a scheduled payment has failed, you are required to contact us to rectify the failed payment. If you do not rectify the failed payment before the next payment date, you acknowledge that you may lose your reservation.

3.22. You agree to allow our third-party payment provider to deduct funds from your Nominated Payment Option. If the third-party payment provider is unable to deduct funds from your Nominated Payment Option, you acknowledge that it will continue to attempt to deduct those funds until the payment has been effected or your booking has been canceled, whichever comes earlier.

3.23. You must make full payment prior to the time period set forth in the Pricing Page.

3.24. You represent and warrant that if you are making online payments that (i) any credit card, debit card and bank account information you supply is true, correct and complete, (ii) charges incurred by you will be honored by your credit/debit card company or bank, (iii) you will pay the charges incurred by you in the amounts posted, including any applicable taxes, and (iv) you are the person in whose name the card was issued and you are authorized to make a purchase or other transaction with the relevant credit card and credit card information.

Right to Refuse Service and Terminate
3.25. In the event that you miss two or more payments, we reserve the right to cancel your reservation for a Travel Related Product and charge a cancellation fee as set forth in the Pricing Page.

3.26. PayLater Travel reserves the right to refuse service to anyone, for any reason, at any time.

3.27. PayLater Travel is dedicated to maintaining a respectful and safe environment for both our customers and employees. We endeavour to solve any query to the best of our ability, however we reserve the right to refuse service, restrict access to our services, or terminate any service agreements in the event that our employees are subjected to abusive, threatening, or harassing behaviour. This includes, but is not limited to, verbal abuse, offensive or discriminatory language, intimidation, harassment (whether sexual or otherwise), and physical threats. By engaging with our services, you agree to treat our staff with respect and understand that failure to do so may result in the immediate suspension or termination of services.

4. Travel Providers

Travel Provider Contracts; Waiver
4.1. By choosing your preferred flight option and Travel Provider through the Product Listing page, you consent to PayLater Travel making your chosen travel arrangement with your chosen Travel Provider on your behalf, as if you were in fact procuring it for yourself, and you agree to be bound by the relevant Travel Provider’s contract terms and conditions.

4.2. By choosing your preferred flight option and Travel Provider through the Product Listing page, you acknowledge that PayLater Travel does not have any control over, and are not responsible or liable for, your Travel Related Product. PayLater Travel is only responsible for our Service and related obligations under these Terms. You acknowledge, as if you had procured the Travel Related Product yourself, that you bear the risk of your chosen Travel Provider canceling, changing, overbooking, delaying or dishonoring your travel arrangement, entering into voluntary administration, declaring bankruptcy or committing an act of insolvency.

4.3. Accordingly, your legal rights in connection with the Travel Related Product are against the specific Travel Provider and are not against us (except to the extent a problem is either caused by a fault on our part in relation to the Services provided by us).

4.4 YOU HEREBY WAIVE AND RELEASE ANY AND ALL CLAIMS, LIABILITIES, AND CAUSES OF ACTION, KNOWN OR UNKNOWN RELATING TO ANY TRAVEL PROVIDER CANCELING, CHANGING, OVERBOOKING, DELAYING OR DISHONORING YOUR TRAVEL ARRANGEMENT OR OTHERWISE ARISING FROM ANY DAMAGES, PERSONAL INJURY, INCLUDING DEATH, PROPERTY LOSS OR DAMAGE, OR OTHER LOSSES OR INJURIES YOU MAY INCUR IN USING ANY TRAVEL RELATED PRODUCT OR THAT IS OTHERWISE CAUSED BY THE ACTION OR INACTION OF ANY TRAVEL PROVIDER.  IN ACCORDANCE WITH CALIFORNIA CIVIL CODE SECTION 1542, YOU EXPRESSLY WAIVE ANY RIGHTS YOU MAY HAVE UNDER THIS STATUTE, WHICH STATES:
“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

Entering your booking details
4.5. We make your travel arrangements in line with the details you provide to us.

4.6. If you become aware of any error or omission in booking details you must notify us as soon as practicable.

4.7. Should errors or omissions be made by reason of an error or omission made by PayLater Travel, any charges incurred with be borne at our expense.

4.8. Any charges incurred by reason of an error or omission on your behalf will be borne by you. This includes, but is not limited to:
  1. Total number of pepole travelling
  2. First and last names of all passengers as they appear on valid government-issued documents.
  3. Ages of all passengers as they appear on valid government-issued documents.
Obtaining additional travel features/products/services
4.9. You are required to bear the costs for any additional products or services in relation to your Travel Related Product that are not expressly stated as being included within the quote you receive from PayLater Travel.

4.10. Prices quoted and charged by PayLater Travel do not include personal expenditure such as, without limitation, travel insurance, seat selection or ancillaries, emergency evacuation costs, drinks, excess baggage, passport & visa fees, gratuities, and vaccination costs.

Travel Provider cancellations, changes, overbookings and delays
4.11. You acknowledge that PayLater Travel is not responsible for any revisions your chosen Travel Provider may make to your booking. All bookings are subject to supplier availability and should a Travel Provider make changes to your booking, which can occur at any time, we will make reasonable attempts to advise you of your options.

4.12. You acknowledge, as if you had procured the Travel Related Product yourself, that you are responsible for reorganizing your travel arrangements and bearing the relevant costs, subject to any arrangement or terms and conditions offered to you by your Travel Provider or insurance provider, should you miss your flight or should your Travel Provider cancel, delay or overbook your chosen travel arrangement.

4.13. If a Travel Provider cancels your Travel Related Product, PayLater Travel will only be liable to provide a refund to you to the extent that PayLater Travel actually receives a cash refund from the relevant Travel Provider. Where cash refunds are due to you from a Travel Provider, PayLater Travel reserves the right to deduct a cancellation fee for the provision of our services to obtain such cash refunds as set forth in the Pricing Page.

4.14. If a Travel Provider cancels your Travel Related Product, they may offer travel credit with the Travel Provider in accordance with their terms and conditions. While we do not control these commercial terms, PayLater Travel will provide reasonable assistance to convert your flights into airline credit that can be redeemed with the Travel Provider upon full and final payment. Any travel credit must be used with the same Travel Provider and the same passenger as the original booking.

Refunding and/or Canceling Travel Related Products
4.15. It is your responsibility to notify us as soon as possible of a cancellation, or intention to cancel, the Travel Related Product. Cancellations can be made at any time (for cancellable products), but please note cancellation fees will apply to all passengers who are booked to occupy a seat (infants who sit on their parent or guardian’s laps may be exempt, subject to airline terms and conditions:
  1. a PLT Termination Charge of 10% of the booking cost capped at $150 per passenger will apply,
  2. any airline cancellation penalty as stipulated in the fare rules
  3. you will not receive a refund for any flights identified as non-refundable on our website.
This applies to all passengers occupying a seat; infants who sit on a parent or guardian’s lap may be exempt, subject to airline terms and conditions.

4.16. No cancellation fees will apply during the cooling off period provided by the Travel Provider (“Cooling Off Period”). Once the Cooling Off Period has ended, the cancellation fees set forth in the Pricing Page will apply.

4.17. PayLater Travel will only be liable to provide a refund to you to the extent that PayLater Travel actually receives a refund from the relevant Travel Provider. Where refunds are due to you from a Travel Provider, we will provide reasonable assistance to you in claiming such funds from that Travel Provider.

4.18. Should a Travel Provider not provide a cash refund to PayLater Travel, PayLater Travel will provide reasonable assistance to convert your flights into airline credit that can be redeemed with the Travel Provider. This credit must be used with the same Travel Provider and the same passenger as the original booking.

4.19. Once you have lodged a cancellation request with our team, refunds will be processed and completed within 4-10 weeks, with 75% of cases completed within 6 weeks.

4.20 Some Travel Related Products may be non-cancellable if they are sold that way by the Travel Provider (“Non-Cancellable Products”).  We will notify you at the time of purchase if you are requesting a Non-Cancellable Product.  When we purchase these Non-Cancellable Products on your behalf as part of the Services, we are unable to cancel and thus, notwithstanding anything to the contrary in these Terms, you will be responsible for the full cost of the Non-Cancellable Product plus any applicable cancellation fee.  YOU ACKNOWLEDGE AND AGREE THAT YOU ACCEPT FULL FINANCIAL RESPONSIBILITY FOR ALL NON-CANCELLABLE PRODUCTS WHETHER OR NOT YOU ACTUALLY USE THE NON-CANCELLABLE PRODUCTS.

4.21 In certain extreme circumstances, a Travel Provider may waiver their cancellation or change fees. This is at the discretion of the Travel Provider and is not a guarantee. In these instances, PayLater Travel will similarly waive their applicable fees.

Travel Provider Insolvency
4.22. Should a Travel Provider enter into voluntary administration, declare bankruptcy or commit an act of insolvency, you acknowledge that we have no control over whether the Travel Provider will complete the transaction, nor can we ensure you will be able to recuperate money from the Travel Provider.

4.23. PayLater Travel will only be liable to provide a refund to you to the extent that it receives a refund from the relevant Travel Provider.

4.24. You acknowledge that the obligation to repay or pay PayLater Travel the agreed amounts on the dates outlined in your Payment Schedule remains, even in the event of a Travel Provider becoming insolvent or entering in voluntary administration, subject to our discretion.

5. Confidentiality and use of Personal Information

5.1 You agree to provide current, complete and accurate account information. You agree to promptly update your account and other information, including your email address, phone numbers and identification details so that PayLater Travel can complete your transactions and contact you as needed.

5.2. Your submission of personal information through our site or other contact channels such as SMS, email, voice, will be governed by the terms of our Privacy Notice.  In the event of any conflict between these Terms and our Privacy Notice, our Privacy Policy will govern.

5.3. We will only use your personal information in accordance with our Privacy Notice, including, for instance, as necessary to effect payments with our third party service providers and confirm your Travel Related Product bookings with your chosen Travel Provider.

5.4. Your personal information will be stored on our secure platform only.

5.5. All payment information will be encrypted.

6. No Warranty

6.1. WE DO NOT GIVE ANY EXPRESS WARRANTY OR GUARANTEE AS TO THE SUITABILITY, RELIABILITY OR AVAILABILITY OF OUR SERVICE, TRAVEL RELATED PRODUCTS, OR TRAVEL PROVIDERS, OR OF THE CONTENT ON OUR WEBSITE.

6.2. EXCEPT AS REQUIRED BY LAW, THE WEBSITE, INCLUDING ANY CONTENT OR INFORMATION CONTAINED WITHIN IT, OR ANY SERVICES RELATED TO THE PLATFORM, IS PROVIDED “AS IS,” WITH ALL FAULTS, WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUALITY OF INFORMATION, QUIET ENJOYMENT, AND TITLE/NON-INFRINGEMENT.

6.3. EXCEPT AS REQUIRED BY LAW, WE DO NOT GUARANTEE CONTINUOUS, UNINTERRUPTED OR SECURE ACCESS TO OUR SERVICE OR WEBSITE, AND WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE AMOUNT OF TIME NEEDED TO COMPLETE PROCESSING OF PAYMENTS OR REFUNDS.

7. Limitations of Liability

7.1. While we arrange your vacation, which will be provided by other suppliers. PayLater Travel does not itself provide the transport, accommodation, meals or other facilities described on this website that you may receive on your vacation, all of which are provided by air and land carriers, cruise operators, hoteliers or suppliers of other services as principals.

7.2. We bear no responsibility as an intermediary and cannot be held responsible in case of damage caused to you by any of our suppliers.

7.3. PAYLATER TRAVEL AND ANY THIRD PARTIES MENTIONED ON THE PLATFORM ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING IN ANY WAY TO THE PLATFORM, SERVICES, CONTENT OR INFORMATION CONTAINED WITHIN THE PLATFORM, AND/OR ANY LINKED WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE PLATFORM, SERVICES, AND/OR LINKED WEBSITES IS TO STOP USING THE PLATFORM AND/OR THOSE SERVICES. TO THE EXTENT ANY ASPECTS OF THE FOREGOING LIMITATIONS OF LIABILITY ARE NOT ENFORCEABLE, THE MAXIMUM AGGREGATE LIABILITY OF COMPANY TO YOU WITH RESPECT TO YOUR USE OF THE PLATFORM IS THE AMOUNT PAID BY YOU TO COMPANY PURSUANT TO THIS AGREEMENT DURING THE 12 MONTHS PRIOR TO THE DATE ON WHICH THE APPLICABLE CLAIM GIVING RISE TO THE LIABILITY AROSE UNDER THIS AGREEMENT.

8. Mobile Terms of Service

8.1 The PayLater Travel mobile message service (the "Message Service") is operated by PayLater Travel. Your use of the Message Service constitutes your agreement to the terms of this Section 8 (“Mobile Terms”). We may modify or cancel the Message Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Message Service following the effective date of any such changes shall constitute your acceptance of such changes.

8.2 By consenting to the Message Service, you agree to receive recurring SMS/text messages from and on behalf of PayLater Travel through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Message Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

8.3 You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with PayLater Travel. Your participation in this program is completely voluntary.

8.4 We do not charge for the Message Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

8.5 You may opt-out of the Message Service at any time. Text the single keyword command STOP to PayLater Travel or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to PayLater Travel mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

8.6 For Message Service support or assistance, text HELP to PayLater Travel or email support@paylatertravel.com.

8.7 We may change any short code or telephone number we use to operate the Message Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

8.8 The wireless carriers supported by the Message Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

8.9 To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Message Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Message Service.

9. Indemnification

8.1. You agree to indemnify, defend and hold harmless PayLater Travel and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable legal fees, made by any third-party due to or arising out of your breach of this Agreement or the documents any third-party may incorporate by reference, or your violation of any law or the rights of a third-party.

10. Termination

10.1. This Agreement is effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying PayLater Travel in writing that you no longer wish to use our Services, or when you cease using our site and Services.  We may terminate these Terms of Service at any time with or without cause upon notice to you (which may be via e-mail or through our Services), provided that if we terminate without cause under this paragraph your obligations to pay for any Services and our obligation to provide Services will survive solely with respect to Travel Related Products purchased by you and for which you have paid a deposit.

10.2. Any obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this Agreement for all purposes.

10.3. If in our sole judgment you fail, or we reasonably suspect that you have failed, to comply with any term or provision of these Terms of Service, PayLater Travel also may terminate this Agreement at any time with written notice to you, effective immediately. Upon termination, cancellation and refund policies as set forth herein shall apply.

11. Interpretation

11.1. Headings are for convenience only and do not affect interpretation.

11.2. Any failure by PayLater Travel to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

11.3. This Agreement and any policies or operating rules posted by PayLater Travel on this site or in respect to the Service constitutes the entire agreement and understanding between you and PayLater Travel and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and PayLater Travel (including, but not limited to, any prior versions of the Terms of Service).

11.4. Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

11.5. In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

12. Dispute Resolution

We will try work in good faith to resolve any issue you have with the Platform, including any products or services ordered or purchased through the Platform, if you bring that issue to the attention of our customer service department. However, we realize that there may be rare cases where we may not be able to resolve an issue to a customer's satisfaction.

YOU AND PAYLATER TRAVEL ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.

ANY CLAIM, DISPUTE OR CONTROVERSY (WHETHER IN CONTRACT, TORT OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN YOU AND US ARISING FROM OR RELATING IN ANY WAY TO YOUR USE OF THE PLATFORM OR SERVICES, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION.

Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. The arbitration will be administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. You agree that, by agreeing to these Terms of Service, the Federal Arbitration Act will govern the interpretation and enforcement of this section.

The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the agreement is void, voidable or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.

If you seek arbitration or elect to file a small claim court action, you must first send PayLater Travel, by certified mail, a written notice of your claim (a “Notice”) to 107 Spring Street, Seattle, WA 98104, United States. If PayLater Travel initiates the arbitration, it will send such Notice to you in accordance with this section. A Notice, whether sent by you or PayLater Travel, must: (a) describe the nature and basis of the claim or dispute; and (b) describe the specific relief sought (the “Demand”). If you and PayLater Travel do not reach an agreement to resolve the claim within 30 days after the Notice is received, you or PayLater Travel may commence an arbitration proceeding or file a claim in small claims court. The arbitration or small-claims court proceeding will be limited solely to your individual dispute or controversy.

You agree to an arbitration on an individual basis. In any dispute, neither you nor PAYLATER TRAVEL will be entitled to join or consolidate claims by or against other customers in court or in arbitration or otherwise participate in any claim as a class representative, class member or in a private attorney general capacity. The arbitral tribunal may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding. The arbitral tribunal has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction.

This arbitration clause shall survive the termination of these Terms of Service. If this specific provision is found to be unenforceable, then (a) the entirety of this arbitration provision shall be null and void, but the remaining provisions of these Terms of Service shall remain in full force and effect; and (b) exclusive jurisdiction and venue for any claims will be as set forth below.

13. Governing Law

13.1. The Agreement will be governed by and interpreted in accordance with the laws of Delaware. If Section 12 is found to be unenforceable, then you irrevocably submit to the exclusive jurisdiction of the courts of the State of Delaware.

14. Governing Law

14.1. In the event that any of the Terms of Service are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms of Service shall otherwise remain in full force and effect. These Terms of Service constitute the entire agreement between Company and you pertaining to the subject matter hereof. In its sole discretion, PayLater Travel may from time-to-time revise these Terms of Service by updating this posting. You should, therefore, periodically visit this page to review the current Terms of Service, so you are aware of any such revisions to which you are bound. Your continued use of the Platform after revisions to these Terms of Service shall constitute your agreement to the revised Terms of Service.

16. Pricing Page

Non-refundable Deposit: Payment of at least 10%, or a different amount that is provided at the time of purchase, of your total quote must be paid as a non-refundable deposit.

Service Fee: The total quote is inclusive of a service fee, which may be incorporated into the non-refundable deposit.

Change Fee: Any changes and amendments of Travel Related Products on your behalf will incur a change fee of $75 per change, per passenger, plus all applicable fees related to the Travel Provider. This fee is applicable to all passengers who booked to travel on their own seat; infants who sit on their parent or guardian’s lap for the duration of the flight may be exempt. Payment schedules must be up to date prior to making a change to your booking.

Cancellation Fee: In the event that (a) you cancel the Travel Related Product after the Cooling Off Period (as described in the Terms and Conditions or (b) PayLater Travel terminates your booking as a result of two missed payments, you must pay a cancellation fee equal to the total of the following:
  • Cancellation Fee equal to 10% of the total booking quote, up to $150 per passenger; and
  • all applicable fees required by the Travel Provider related to the cancellation; and
  • if the Travel Related Product is non-refundable, all non-refundable payments PayLater Travel made on your behalf to third party suppliers.
This fee is applicable to all passengers who booked to travel on their own seat; infants who sit on their parent or guardian’s lap for the duration of the flight may be exempt. Any fees already paid to PayLater Travel will be deducted from such amount.All payment schedules must be complete prior to cancelling your booking.

Payment Schedule
You must make full payment at least 2 weeks prior to the date of your travel departure.You must pay the agreed amounts on the dates outlined in your Payment Schedule, which is customizable by you to the extent that you can choose:
  • Whether to pay your installments weekly or every two weeks;
  • When you would like your installments to start; and/or
  • How long you would like your payment period to be (of up to 6 months), with the final balance required at least 2 weeks prior to departure.
